Agreement to Terms
These Terms of Use ("Terms") govern your access to and use of farwestnotary.com (the "Site") and any mobile notary or Remote Online Notarization ("RON") services you request from Far West Notary ("we," "us," or "our"). By using the Site or engaging our services, you agree to these Terms. If you do not agree, please do not use the Site or request our services.
Our Services
Far West Notary provides mobile notary services throughout the greater San Antonio, Texas area and Remote Online Notarization for signers located within Texas, performed by a Texas-commissioned notary public. Appointments are scheduled by phone or email and confirmed before service is rendered.
Scheduling, Fees & Payment
- All appointments are by request and subject to confirmation. Fees are quoted before your appointment and are based on our posted fee schedule, which includes both state-regulated notarial fees and our own travel or scheduling fees.
- Travel, scheduling, and any other fees not tied to the notarial act itself are due at least two hours before the scheduled appointment time. If these fees are not paid by that deadline, we may cancel the appointment. For appointments scheduled less than two hours out, these fees are due at the time of scheduling.
- Fees paid ahead of the appointment are non-refundable if the appointment is canceled less than 24 hours before the scheduled time, or if the signing is unable to proceed for any reason at the appointment (for example, missing identification, an incomplete document, or the signer being unwilling or unable to sign).
- Notarial fees for the notarization itself are collected at the time service is rendered unless another arrangement is agreed in advance.
- Notarial fees reflect the maximums permitted under Texas Government Code §406.024 and §406.111. Travel, courier, and scheduling fees are set by Far West Notary and disclosed on our Pricing page.
Your Responsibilities
To be notarized, a signer must:
- Appear in person (for mobile notarization) or via live audio-video session (for RON)
- Present valid, government-issued photo identification acceptable under Texas law
- Sign willingly, without coercion, and demonstrate an understanding of the document being signed
- Bring a complete document — we do not draft, correct, or fill in documents on your behalf
We reserve the right to decline or stop a notarization at any time if we have reason to believe a signer is not who they claim to be, is signing under duress, does not appear to understand the transaction, or if the document or circumstances raise any concern about fraud or legality — consistent with the duties of a Texas notary public.
Remote Online Notarization (RON)
- RON sessions require a stable internet connection, a working camera and microphone, and identity verification through a third-party platform (such as knowledge-based authentication and credential analysis).
- Texas law requires the audio-video session to be recorded and retained; by participating in a RON session, you consent to this recording.
- We are not responsible for technology failures, connectivity issues, or platform outages outside our control, though we will make reasonable efforts to reschedule if a session cannot be completed.
No Legal, Financial, or Tax Advice
Nothing on this Site or provided during a notarial appointment constitutes legal, financial, tax, or real estate advice. Any general information we share is for convenience only and should not be relied upon as professional advice. You are solely responsible for the content, accuracy, and legal effect of any document you ask us to notarize.
Disclaimer of Warranties
The Site and our services are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure.
Limitation of Liability
To the fullest extent permitted by Texas law, Far West Notary's total liability for any claim arising out of or relating to our services or this Site — whether in contract, tort, or otherwise — is limited to the amount you paid for the specific notarial act giving rise to the claim. We are not liable for indirect, incidental, consequential, or punitive damages, including losses arising from a document's legal effect, a third party's rejection of a notarized document, or delays outside our reasonable control. Nothing in these Terms limits liability that cannot be limited under Texas law, including liability arising from a notary's willful misconduct or gross negligence.
Indemnification
You agree to indemnify and hold Far West Notary harmless from any claims, damages, or expenses (including reasonable attorney's fees) arising from your misuse of the Site, a document you asked us to notarize, or your breach of these Terms.
Intellectual Property
The Site's content, design, and the Far West Notary name and logo are the property of Far West Notary and may not be copied, reproduced, or used without our written permission.
Third-Party Links & Services
The Site may reference or link to third-party services (such as Google Analytics or a RON platform). We are not responsible for the content, availability, or practices of third-party sites or services, which are governed by their own terms and privacy policies.
Governing Law & Venue
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any dispute arising from these Terms or our services will be brought exclusively in the state or federal courts located in Bexar County, Texas.
Changes to These Terms
We may update these Terms from time to time. The effective date above reflects the most recent revision. Continued use of the Site or our services after changes take effect constitutes acceptance of the updated Terms.
Severability
If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.
